1 Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and SaleGun ("we", "us", or "our") governing your access to and use of the SaleGun mobile application ("App") and the website at salegun.com ("Website").

By downloading, installing, or using the App, or by accessing the Website, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you must not use the App or Website.

2 Description of the App

SaleGun is a mobile sales productivity application that helps sales professionals manage contact lists, log call outcomes, set follow-up reminders, and track their daily calling performance. The App operates entirely on-device — no user account is required and no data is transmitted to our servers.

The App is available on:

  • iOS devices via the Apple App Store
  • Android devices via the Google Play Store

3 Free Tier and Premium Subscription

Free Tier. SaleGun is free to download and use. The free tier allows you to manage up to 100 contacts and make up to 20 calls per day. There is no time limit on the free tier, and no credit card or registration is required.

SaleGun Premium. To manage more than 100 contacts or make more than 20 calls per day, you may purchase a SaleGun Premium subscription. The subscription is offered on the following terms:

  • Price: $3.99 USD per month (or the equivalent in your local currency as determined by the applicable app store)
  • Billing: Payment is charged to your Apple ID or Google Play account at the time of purchase confirmation
  • Auto-renewal: Your subscription automatically renews monthly unless you cancel at least 24 hours before the end of the current billing period
  • Renewal charge: Your account is charged for renewal within 24 hours before the current period ends, at the then-current subscription price
  • Cancellation: Cancel at any time through your Apple ID account settings (iOS) or Google Play account settings (Android). Access continues until the end of the paid period
  • Price changes: We will provide reasonable advance notice of any price change. Continued use after a price change constitutes acceptance

Important: All payments are processed entirely by Apple or Google. We do not collect, receive, or store your payment information. Refund requests must be directed to Apple or Google in accordance with their respective refund policies.

Free Trial. We may offer a free trial period from time to time. Any unused portion of a free trial is forfeited upon purchase of a paid subscription.

4 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal or internal business purposes.

This license does not permit you to:

  • Copy, modify, distribute, sell, or sublicense the App or any portion of it
  • Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the App
  • Use the App to build a competing product or service
  • Use automated scripts, bots, or tools to interact with the App in any unauthorized manner

5 Acceptable Use

You may use SaleGun solely for lawful purposes. You agree not to use the App:

  • To contact individuals without a lawful basis or prior consent where required by applicable law
  • To send unsolicited commercial communications in violation of telemarketing or anti-spam laws — including TCPA (US), GDPR (EU), CASL (Canada), or equivalent regulations in your jurisdiction
  • To store or process data that you do not have the legal right to use
  • For any illegal, fraudulent, abusive, harassing, defamatory, or otherwise harmful purpose
  • In any manner that could damage, disable, or impair the App

6 Your Data and Responsibilities

All data you enter into SaleGun is stored locally on your device. We have no access to it. You are the data controller of any personal data you process through the App and bear full responsibility for its lawful use, including:

  • Ensuring you have a valid legal basis to store and contact the individuals on your lists
  • Complying with applicable data protection laws: GDPR (EU/EEA), CCPA (California), LGPD (Brazil), POPIA (South Africa), TCPA (United States), and any other regulations applicable to your jurisdiction
  • Honouring opt-out or do-not-contact requests from individuals on your lists
  • Securing your device against unauthorised access

We are not responsible for any unlawful, negligent, or unauthorized use of the data you manage within the App.

7 Intellectual Property

The App, Website, and all content, features, and functionality — including software, text, graphics, logos, and designs — are owned by SaleGun and protected by applicable intellectual property laws. You acquire no ownership rights in the App by virtue of downloading or using it.

"SaleGun" and the SaleGun logo are trademarks of SaleGun. You may not use these marks without our prior written permission.

8 Third-Party Services

The App is distributed through the Apple App Store and Google Play Store. Your use of those platforms is governed by Apple's and Google's respective terms of service. We are not responsible for those platforms.

Apple and Google are not responsible for the App, its content, or any claims arising from its use. In the event of any App warranty failure, you may notify Apple or Google and they may refund the purchase price paid, if any — this is their sole warranty obligation with respect to the App.

9 Disclaimer of Warranties

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ANY SPECIFIC SALES RESULTS OR BUSINESS OUTCOMES FROM YOUR USE OF THE APP.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SALEGUN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID FOR A SALEGUN PREMIUM SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.

Some jurisdictions do not allow limitation of liability for consequential damages, so some of the above may not apply to you.

11 Indemnification

You agree to defend, indemnify, and hold harmless SaleGun and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your use of the App or Website; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your processing of any third-party personal data through the App.

12 Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. If your subscription is active at the time of termination for cause, no refund will be issued.

You may stop using the App at any time by uninstalling it. If you have an active subscription, uninstalling the App does not cancel it — you must cancel through your Apple or Google account settings.

13 Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of these Terms that cannot be resolved amicably shall be submitted to the competent courts of the jurisdiction in which we are established.

Nothing in these Terms limits your rights as a consumer under the mandatory consumer protection laws of your country of residence.

14 Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last updated" date above. Material changes will be communicated via the App's release notes on the App Store and Google Play. Your continued use of the App after the updated Terms take effect constitutes your acceptance. If you do not agree, you must stop using the App and cancel any active subscription.

15 Severability

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary, or severed if modification is not possible. The remaining provisions continue in full force and effect.

16 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SaleGun regarding the App and Website, and supersede all prior agreements and understandings.
